Social Media Promotion Terms & Conditions

1. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

2. Agreement to Official Rules. By participating in this Promotion, participants agree to be bound by these Terms & Conditions and by the decisions of the Sponsor, which shall be final and binding in all matters relating to the administration of this Promotion and selection of the winner. Failure to comply with these Terms & Conditions may result in disqualification from the Promotion. This Promotion is sponsored by Motelrocks, USA, Inc., with offices located at 5 Greentree Centre, 525 Route 73 North, Suite 205, Marlton, NJ 08053 (“Sponsor”). 

3. Promotion Period, Selection of Winner, Odds. The Promotion begins on March 8, 2026, and ends at 11:59 p.m. EST on March 11, 2026 (the “Promotion Period”). One (1) winner will be selected in a random drawing conducted on or about March 17, 2026 (“Drawing Date”), from among all eligible entries received during the Promotion Period. The odds of winning depend on the total number of eligible entries received. All eligible entries will have an equal chance of winning. Winner will be selected in a random drawing and not based on the content of the comment submitted. Sponsor will privately notify the winner via the Motel Rocks Instagram account or USPS on or around the Drawing Date. 

4. Eligibility. 

1. This Promotion is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. Employees, officers, and directors of Sponsor and their immediate family members or household members are not eligible to enter. Limit one (1) entry per person and per Instagram account. Multiple entries from the same person or account may be disqualified. Sponsor reserves the right to disqualify any participant who tampers with the entry process, violates these Terms & Conditions, or engages in fraudulent or disruptive conduct. If a potential winner does not respond to Sponsor’s notification within seven (7) days, is found to be ineligible, or fails to comply with these Terms & Conditions, the Prize may be forfeited, and an alternate winner selected at Sponsor’s sole discretion. 

2. Entry Option No. 1: Participants must do the following to enter the Promotion: 

1. Locate and click the promotional post on Motel Rocks’ official Instagram account;  

2. Follow the Motel Rocks’ Instagram account during the Promotion Period; 

3. Click “Like” on the Promotion post; and 

4. Enter a comment on the post sharing spring break plans. 

5. Prize; Approximate Retail Value. One (1) winner will receive the prize bundle described below in these Terms & Conditions (collectively, the “Prize”). The approximate retail value (“ARV”) of the total prize is no more than $585. The ARV is based on current national average retail pricing for the listed swimwear items, sun care products, and electronic accessories at the time these Terms & Conditions were drafted. Actual value may vary.

1. Refurbished Apple iPod Shuffle – fully tested and in good working condition and Apple wired earphones (Apple is not a sponsor of, and is not affiliated with, this Promotion. All trademarks, service marks, and trade names used herein are the property of their respective owners and are used for identification purposes only). 

6. Prize - Notice and Disclaimer. 

1. The Winner shall not have a right to transfer to another or exchange or substitute for cash or another alternative the Prize. Sponsor reserves the right to substitute any portion of the Prize based on availability for something of similar kind and value without prior notice. Certain components of the Prize consist of topical personal care products from the brand “Vacation.” Winner acknowledges that all products within the Prize should be used strictly in accordance with their labeling and instructions. Sponsor makes no representations or warranties regarding suitability for any individual’s skin type, medical condition, or sensitivity. Winner assumes all risks associated with the use of such products. Sponsor shall not be responsible for any adverse reactions, injuries, or damages arising from use or misuse of any prize components.

2. Potential winner may be asked to complete, sign, and return within a specified time period an Affidavit of Eligibility, Liability Release, and, where lawful, Publicity Release (the “Affidavit and Release”), as well as any required tax documentation (including IRS Form W-9). Failure to timely return required documents, provide requested information, or comply with these Terms & Conditions may result in disqualification and selection of an alternate winner.

7. Instagram Mandatory Release and Acknowledgement. This Promotion is in no way sponsored, endorsed, administered by, or associated with Instagram, Meta Platforms, Inc., Twitter, TikTok, or any other Social Media platform (collectively, the “Platforms”). By entering, participants fully release the “Platforms” from any liability arising out of or related to this Promotion. Participants acknowledge and understand that they are providing their information to Sponsor and not to the Platforms. Any questions, comments, or complaints regarding the Promotion must be directed to Sponsor and not to the Platforms.

8. Taxes. All federal, state, and local taxes associated with the receipt or use of the Prize are the sole responsibility of the winner. Because the approximate retail value of the Prize exceeds $600, the winner will be issued an IRS Form 1099 for the fair market value of the Prize and must provide Sponsor with a completed IRS Form W-9 and any other required tax documentation prior to receiving the Prize. Failure to provide required tax documentation may result in disqualification and selection of an alternate winner.

9. Winner List. To request the name of the winner, send a self-addressed, stamped envelope to:

   Requests must be received within sixty (60) days following the Drawing Date.

10. Privacy and Publicity. Personal information collected in connection with this Promotion will be used solely for the purposes of administering the Promotion, contacting and verifying the winner, fulfilling the Prize, and announcing the winner. Such information will be shared with Motel Rocks Limited (United Kingdom), the parent company of Sponsor, and with third-party service providers engaged solely to assist in these activities, and for no other purpose without separate consent. By entering, participants acknowledge that their personal information may be transferred to and processed in the United Kingdom. Participants in states with applicable privacy rights, including California, Virginia, Colorado, Connecticut, and Texas, may have the right to access, correct, or delete their personal information by submitting a request in accordance with the instructions in Sponsor's Privacy Policy at https://www.motelrocks.com/pages/privacy-policy. Except where prohibited by law, such as California, acceptance of the Prize constitutes the winner’s consent (a) to Sponsor’s use of the winner’s name, likeness, city, state, and entry content for promotional and marketing purposes in any Platform, media, worldwide, without further payment or consideration; and (b) Sponsor may announce the winner and the winner’s entry submission on its social media accounts, including the Platforms such as Instagram story. Sponsor may request that the winner consent to commercial use of the winner’s name and likeness in the Affidavit and Release, but such consent is not a condition precedent to winning the Prize. 

11. Receipt of Prize.  The Prize will be shipped within a reasonable time following winner verification and is expected to be delivered within approximately four (4) weeks thereafter. Delivery times may vary based on location and shipping carrier. Sponsor is not responsible for lost, stolen, misdirected, or delayed shipments.

12. Limitation of Liability. By entering the Promotion, participants agree to release and hold harmless Sponsor, its affiliates, officers, directors, employees, and agents from and against any loss, damage, claim, or cause of action arising out of the Promotion or receipt or use of the Prize. Nothing in these Terms & Conditions limits or excludes liability for gross negligence, willful misconduct, or any liability that cannot be limited or excluded under applicable law.

13. Governing Law; Dispute Resolution; Arbitration; Class Action Waiver. This Promotion and these Terms & Conditions are governed by the laws of the State of New Jersey, without regard to its conflict of laws principles. To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to this Promotion or these Terms & Conditions, including the determination of the scope or applicability of this agreement to arbitrate, shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules then in effect. Sponsor shall bear all AAA filing, administration, and arbitrator fees for any arbitration initiated in connection with this Promotion, unless the arbitrator determines the claim was frivolous or brought in bad faith. The Federal Arbitration Act shall govern the interpretation and enforcement of this arbitration provision. The arbitration shall be conducted on an individual basis only and not in a class, collective, consolidated, or representative proceeding. The arbitrator shall have no authority to combine or aggregate the claims of multiple individuals or to preside over any form of class or representative proceeding. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration provision. By entering the Promotion, participants expressly waive any right to participate in a class action, class arbitration, or other representative action against Sponsor. The arbitration shall take place in Burlington County, New Jersey, unless the parties agree otherwise. Judgment on the arbitration award may be entered in any court having jurisdiction thereof. If for any reason a claim proceeds in court rather than arbitration, participants agree that such action shall be brought exclusively in the state courts located in Burlington County, New Jersey, or the United States District Court for the District of New Jersey, Camden Vicinage, and participants consent to the personal jurisdiction and venue of such courts. 

14. Waiver of Jury Trial. To the fullest extent permitted by law, entrants knowingly and voluntarily waive any right to a trial by jury in any court proceeding arising out of or relating to this Promotion or these Terms & Conditions.

15. Severability. If any portion of these Terms and Conditions is determined to be invalid or unenforceable, the remaining portions shall remain in full force and effect to the fullest extent permitted by law.
