1. Introduction, Acknowledgment, and Modification

Motelrocks, USA, Inc. (“Company,” “we,” “us,” or “our”) respects your privacy and is committed to protecting it through our compliance with this Policy (“Privacy Policy” or “Policy”). This Policy describes the types of information we may collect from you or that you may provide when you visit our websites or app, us.motelrocks.com or the Motel Rocks App (collectively, the “Site”), and how we collect, use, maintain, protect, and disclose that information. 

This Policy applies to information we collect:

• on or through the Site, including mobile and desktop applications that you download that provide dedicated non-browser-based interaction between you and the Site;

• in email, text, and other electronic messages between you and the Site; and

• when you interact with our advertising and applications on third-party websites if those applications or advertisements redirect you to our Site that includes a link to this Policy. 

Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. By accessing or using this Site, you acknowledge and understand this Privacy Policy. This Policy may change from time to time (as more fully set forth in Section 12 (Changes to Our Privacy Policy). Your continued use of this Site after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates. 

1. Children’s Privacy and Age Restrictions

Our Site is a general-audience website and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without legally required consent, we will delete that information as required by law. If you believe we may have collected personal information from or about a child under 13, please contact us at legal@motelrocks.com .

With respect to users between the ages of 13 and 15, we do not sell or share their personal information for purposes of targeted advertising or cross-context behavioral advertising without affirmative opt-in consent, where required by applicable law.

Our purchasing functions and promotional programs, including SMS and email marketing programs, are intended for individuals who are at least 18 years old or the age of majority in their state of residence, whichever is older. By placing an order or subscribing to promotional or marketing communications, you represent and warrant that you meet that requirement. If we learn that an individual enrolled in one of our promotional or marketing programs does not meet this requirement, we may remove that individual from the program and delete or suppress related information as appropriate and as required by law. We may collect the following categories of personal information about you, directly or indirectly (collectively, “personal information”):

• Internet or Network Activity (e.g., internet connection, IP address, usage details, and browsing behavior); 

• Device Information (e.g., equipment, browsers, and operating system); and

• Preferences and Demographics (e.g., experiences with our products, preferences, interests, and usage details). 

Some of the information we collect may be considered “sensitive personal information” under applicable law, including payment card information. We collect and use sensitive personal information only as necessary to fulfill the purposes described in this Policy — specifically, to process your transactions, prevent fraud, and fulfill your orders — and for no other purposes except as permitted by applicable law. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria. 

We do not sell personal information in exchange for money. However, we do share certain categories of personal information — including identifiers, internet activity, and device information — with advertising partners for targeted advertising purposes. Under certain state privacy laws, including the California Consumer Privacy Act, this type of sharing may be considered a “sale” or “sharing” of personal information. You have the right to opt out of this sharing as described in Section 8 and Section 10 of this Policy.

5. Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

6. Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications, including advertisements, on the Site are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Site. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different Sites and other online services. We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information: 

• Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly. You may also manage your cookie preferences at any time through our cookie preference center, accessible via the “Cookie Preferences” link on our Site.

• Marketing Communications from Us. If you do not wish to have your contact information used by us to send you promotional or marketing communications about our products and services, you may opt out by sending an email to legal@motelrocks.com  with the subject line “Opt Out - Marketing.” This opt-out does not apply to transactional or service-related communications such as order confirmations, shipping notices, or account notifications.

If you do not want us to share your personal information with third-party advertising partners, or to use information we collect about you to deliver targeted advertisements, you may opt out by sending an email to legal@motelrocks.com  with the subject line “Opt Out - Advertising.” California residents and residents of other states with applicable privacy laws may also exercise this right through the “Do Not Sell or Share My Personal Information” link on our website.

• We do not use or disclose sensitive personal information except as permitted by applicable law.

We do not control third parties’ collection or use of your information to serve interest-based advertising except as required by applicable law. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s Site. We honor browser-based opt-out signals, such as the Global Privacy Control (GPC), where required by applicable law. California residents may also exercise this right by using the “Do Not Sell or Share My Personal Information” link available on our website, where applicable.

8. Accessing and Correcting Your Information

Subject to applicable law, you may have the right to request access to, correction of, deletion of, or a copy of your personal information. Subject to the limitations in this Section, you may also send us an email at legal@motelrocks.com to request access to, correct or delete any personal information that you have provided to us that we maintain in a personal file for customers. We will respond to your request in accordance with applicable law. We may not be able to delete certain personal information except by also deleting your user account. If a transaction has not yet been completed, we may not be able to delete necessary information to fulfill our legal obligations.  If a dispute arises relating to a transaction, or we believe the retention of information is necessary for tax, legal, or similar purposes for our protection, then we may not be able to delete such information. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

9. Your State Privacy Rights

Depending on your state of residence, you may have certain rights regarding your personal information, subject to applicable exceptions and limitations under law. These rights may include the right to request access to, correction of, or deletion of your personal information, to request a copy of your personal information in a portable format, and to opt out of certain processing activities, such as targeted advertising, the sale or sharing of personal information, or profiling in furtherance of decisions that produce legal or similarly significant effects, where applicable.

We will not discriminate against you for exercising any privacy rights available to you under applicable law. If you choose to exercise certain rights, some features or services may be unavailable to you.

In the preceding 12 months, we have shared the following categories of personal information with advertising partners for targeted advertising purposes, which may constitute a “sale” or “sharing” under California law: Identifying Information, Internet or Network Activity, Device Information, and Preferences and Demographics. These categories have been shared with advertising networks, analytics providers, and social media platforms.

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. The specific retention period for each category of personal information varies depending on the nature of the information and the purposes for which it is processed, as well as applicable legal, tax, accounting, and operational requirements.

California residents have the right to opt out of the sale or sharing of their personal information. To exercise this right, California residents may click the “Do Not Sell or Share My Personal Information” link available on our Site, or contact us at legal@motelrocks.com  with the subject line “California Privacy Request — Do Not Sell or Share.” We will process your request in accordance with applicable law.

10. Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. We use reasonable administrative, technical, and physical safeguards designed to protect personal information. Payment information is encrypted using industry-standard encryption technologies. Accordingly, we cannot guarantee the security of your personal information.  

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. 

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site. If we experience a security incident involving your personal information, we will investigate promptly and provide any required notices without unreasonable delay and in accordance with applicable law, including applicable state data breach notification requirements. 12. Text Messaging 

If you provide your phone number and opt in to receive text messages from us, you confirm that you are at least 18 years old or the age of majority in your state of residence, whichever is older, and that you are authorized to consent to receive marketing text messages at the number provided. Our text messaging programs are intended only for individuals who meet these requirements. If we learn that an individual enrolled in one of our text messaging programs does not meet these requirements, we may remove that individual from the program and delete or suppress related information as appropriate and as required by applicable law.

By providing your phone number and opting in, including at checkout, when initiating a purchase, through a subscription form, or by sending a keyword, you consent to receive text messages from us in accordance with applicable law, including messages relating to your order, abandoned cart reminders, and marketing or promotional offers. Consent to receive marketing text messages is not a condition of any purchase. Message frequency may vary, but we generally do not exceed 30 text messages per month. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Text messages may be sent using an automatic telephone dialling system or other automated technology, as permitted by applicable law.

Our text messaging program is operated with the assistance of a third-party messaging platform. Text messages are sent using a third party messaging platform provider “ATTENTIVE”. By opting in to receive text messages from us, you acknowledge that your phone number and messaging preferences will be shared with our messaging platform provider solely for the purpose of administering our text messaging program.
